This document is an electronic record in terms of the amended Information Technology Act, 2000, and rules and regulations made thereunder. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the Terms for access or usage of Shivam Info's services via the website www.batteryfair.co.in. This document meets the stipulations and conditions mentioned in Section 65B (2) of the Indian Evidence Act, 1872.

YOUR ACCEPTANCE OF THIS AGREEMENT:

This is an agreement between you ("you" or "your") and Shivam Info, a firm with its office at Shop No.6, CSC, Block B, Dilshad Garden, Delhi-110095 (together "Company," "we," "us," or "our") that governs your use of the Power On Expo / BatteryFair events, our websites www.batteryfair.co.in and www.poweronexpo.in ("Websites"), the Power On app, and our WhatsApp, email, SMS, and telephone communications (collectively "Platforms"). When you access or use any of the Platforms, you agree to be bound by these Terms and Conditions ("Terms").

YOUR RESPONSIBILITIES

You agree that you will use this website in a lawful manner that is consistent with all applicable laws and regulations.
You agree that you are responsible for the security and use of any usernames or passwords needed to access or use the website.
You must take all reasonable steps to ensure that these usernames and passwords are kept confidential and secure and you do not allow any unauthorized person to access the website using your username or password.
You take full responsibility for all information and instructions transmitted through the website using your username and/or password. All such information will be considered by Shivam Info to be sent and authorized by you.
You agree that you will not use the website to use or transmit any material that contains software viruses or any other computer code, file or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, including but not limited to the website.
If you place an order for any subscription, products, and/or services by placing such an order you confirm and warrant that you are 18 years of age or older.

USE OF CONTENT

All logos, brands, marks headings, labels, names, signatures, numerals, shapes or any combinations thereof, appearing in this site, except as otherwise noted, are properties either owned or used under license, by the business and/or its associate entities who feature on this Website. The use of these properties or any other content on this site, except as provided in these terms and conditions or in the site content, is strictly prohibited.

You may not sell or modify the content of this Website or reproduce, display, publicly perform, distribute, or otherwise use the materials in any way for any public or commercial purpose without the respective organization’s or entity’s written permission.

User agrees that neither Company nor its group companies, directors, officers or employees shall be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the service or/and for cost of procurement of substitute goods or/and services or resulting from any goods or/and data or/and information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/and resulting from unauthorized access to or/and alteration of user's transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if Company has been advised of the possibility of such damages.

User further agrees that Company shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent.

User agrees that Company shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Company's total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Company, if any, that is related to the cause of action.

DISCLAIMER OF CONSEQUENTIAL DAMAGES

In no event shall Company or any parties, organizations or entities associated with the corporate brand name us or otherwise, mentioned at this Website be liable for any damages whatsoever (including, without limitations, incidental and consequential damages, lost profits, or damage to computer hardware or loss of data information or business interruption) resulting from the use or inability to use the Website and the Website material, whether based on warranty, contract, tort, or any other legal theory, and whether or not, such organization or entities were advised of the possibility of such damages.

EVENT REGISTRATION AND PASSES

Registration for Power On Expo and our other events is subject to the details, dates, venue and prices shown on our website, app, registration form or WhatsApp message at the time you register. Some registrations (for example early-bird visitor registration) may be free or discounted for a limited period. After that period the standard fees apply.
A pass is personal to the registered person, cannot be sold or transferred without our written consent, and must be shown with a valid photo ID at entry.
Paid registrations are processed through our payment partner (such as Razorpay) and are subject to our Refund and Cancellation Policy.
We may change the programme, speakers, dates or venue if needed, and may refuse or cancel entry for false information, misuse, or breach of these Terms or the venue rules.
A stall or sponsorship enquiry made through a form or WhatsApp is not a booking. A booking is confirmed only when we confirm it in writing or send you an invoice.

WHATSAPP AND OTHER COMMUNICATIONS

By giving us your mobile number or email address, registering for an event, or messaging us, you agree that we may contact you about our events and services by WhatsApp, email, SMS and phone. You can opt out at any time: reply STOP on WhatsApp, use the unsubscribe link in our emails, or contact us. After you opt out we may still send messages you need for something you asked for, such as your pass or a payment confirmation.

WhatsApp messages are delivered through the WhatsApp Business Platform of Meta Platforms, Inc. and are also subject to WhatsApp’s own terms and policies. Your mobile operator’s data charges may apply.

AUTOMATED ASSISTANT

Replies on WhatsApp may be written by an automated AI assistant. They are general information about our events, may not always be complete or correct, and are not an offer or a contract. For prices, bookings and other important decisions, please confirm with our team on +91 96508 77171.

CHANGES IN TERMS

We may update these Terms from time to time. The updated Terms apply from the date they are published on this page.

PRIVACY POLICY

Your use of our Platforms is also governed by our Privacy Policy.

GOVERNING LAW

These Terms are governed by the laws of India. The courts at Delhi have exclusive jurisdiction over any dispute arising from them.
